Terms & Conditions
The terms on which we provide gardening services, garden plans, and supply seeds, tools and saplings.
1. Who we are
These terms are issued by Beppu Global Garden ("we", "us", "our"), operating from . Our contact details are set out in section 20 and on our contact page.
Throughout this document, "you" means the individual or organisation engaging our services or ordering goods from us, and "the site" means the website at beppuglobal.garden.
2. Accepting these terms
By using the site, submitting an enquiry form, placing a telephone order or engaging us to carry out work, you accept these terms. If you do not accept them, please do not use the site or engage us.
Where you are engaging us on behalf of a company, school or other organisation, you confirm that you have authority to bind that organisation to these terms.
If any part of these terms conflicts with a signed written contract between us, the signed contract takes precedence for that engagement.
3. Services we provide
We provide horticultural and landscaping services, including but not limited to garden design, planting, lawn installation and care, tree pruning, hedge trimming, soil testing, integrated pest and disease management, irrigation installation, composting systems, maintenance contracts, workshops, and the supply of seeds, tools, saplings and related goods.
Descriptions, illustrations and specifications on the site are for guidance. Living plants vary naturally in size, form and colour, and illustrations of tools are stylised representations rather than photographs of the exact item supplied.
We may decline any work we consider unsafe, outside our competence, or contrary to good horticultural practice — including work that would damage a tree's long-term health, such as topping.
4. Quotations & garden plans
- Prices shown on the site are indicative starting points for the Beppu and Oita City area. They are not offers capable of acceptance.
- A binding price arises only from a written quotation issued by us following a site survey or, where agreed, a remote consultation.
- Written quotations remain valid for 30 days unless stated otherwise, after which material and plant prices may have changed.
- Garden plan band prices cover the survey, drawings, planting plan and the sapling package listed for that band. Hardscape materials, turf, irrigation components, lighting hardware and tree surgery on existing trees are quoted separately.
- The drawings and planting plan we produce become yours to keep and to use, including by appointing another contractor to build them.
- Where we carry out the build within six months of issuing a plan, 50 % of the plan fee is credited against the build cost.
- Conditions we could not reasonably have identified at survey — buried services, contaminated ground, hidden structures, unexpected drainage failure — are treated as a variation and quoted before any additional work proceeds.
5. Ordering by telephone
Seeds, tools and saplings are ordered by telephone. There is no online checkout on this site and no facility to place a binding order through any form on it.
- You call our order line and tell us the item names and quantities.
- We confirm availability, the total price including tax and delivery, and a delivery or collection slot on the same call.
- A contract is formed at the point we confirm the order on that call, not when you submit any web form.
- We send a written confirmation by email or message where you provide contact details for it.
Any "request a call back" form on this site is an enquiry only. It does not reserve stock and does not create a contract of sale.
We do not supply blades, power tools, sprayers or chemical products to anyone under 18 years of age, and may require proof of age.
6. Prices, tax & payment
- All prices are in Japanese Yen (JPY) and, unless stated otherwise, include consumption tax.
- Goods: payment on delivery by cash or bank transfer, or by card on collection from the garden. Orders above ¥30,000 may require a deposit.
- Services: for projects up to ¥100,000, payment in full on completion. Above that, a 30 % deposit on acceptance, a 40 % stage payment, and the balance within 14 days of completion.
- Maintenance contracts are billed monthly in advance.
- We reserve the right to charge interest on overdue sums at the statutory rate, and to suspend work on an account that is materially in arrears.
- Title in goods passes to you on payment in full. Risk passes on delivery or collection.
- Prices for living plants and materials are subject to change where our own supply costs change between quotation and order; we will always tell you before proceeding.
7. Delivery & collection
- Seed packets: flat ¥400 delivery, free on orders over ¥3,000.
- Tools: free within Beppu and Oita City on orders over ¥8,000; ¥800 below that. Yufu, Hiji and Kitsuki add ¥600.
- Saplings: ¥1,200 per delivery within Beppu and Oita City. Larger specimens quoted individually.
- Collection is free from the garden during Sunday community sessions.
- Delivery dates are estimates. We are not liable for delays caused by weather, transport disruption or supplier failure, but we will keep you informed and offer a revised slot.
- Someone aged 18 or over must be present to receive tools, saplings and chemical products.
- Please inspect goods on delivery and tell us about visible damage within 48 hours.
8. Cancellation & returns
Goods
- Unused tools in original packaging may be returned within 14 days of delivery for a refund, less return carriage.
- Seed packets may be returned unopened within 14 days. Opened seed cannot be returned, for obvious reasons of provenance and viability.
- Living plants and saplings cannot be returned once they have left our care, except under the guarantee in section 9 or where they were defective on arrival.
- Items ordered in specially at your request are non-returnable unless faulty.
- Nothing here limits your statutory rights in respect of goods that are faulty or not as described.
Services
- Cancel a booked visit more than 48 hours in advance at no charge.
- Cancellation within 48 hours may incur a charge of up to 50 % of the visit value, to cover the slot we can no longer fill.
- If we cannot work because of weather or unsafe conditions, we reschedule at no cost to you.
- For design and build projects cancelled after acceptance, you remain liable for work completed, plants and materials already purchased, and a reasonable proportion of design time spent.
- Maintenance contracts may be cancelled by either party on 30 days' written notice.
9. Living plants & guarantees
Plants are living organisms. Their survival depends on aftercare, weather, soil, pests and factors outside anybody's control. Within that reality we guarantee the following.
- Saplings planted by us: 90-day establishment guarantee. If the plant fails within 90 days of planting and you have followed the written care schedule we supplied, we replace it at no charge.
- Saplings you plant yourself: 30 days against defect present on arrival.
- Seeds: guaranteed to meet the germination rate stated on the packet when sown as directed, within the stated season. We cannot guarantee final yield, which depends on your conditions and management.
- Hard landscaping and installations: 12 months against defective workmanship.
- Irrigation systems: 12 months on workmanship; manufacturer terms apply to components.
The guarantees above do not cover: drought or waterlogging caused by aftercare, storm, typhoon, frost or other extreme weather, damage by animals, insects or third parties, vandalism, transplanting by anyone other than us, or failure to follow the written care schedule.
To claim, contact us within the guarantee period with photographs and the plant's location. We may inspect before replacing.
10. Site access & your obligations
To let us work safely and to the standard we promise, you agree to:
- Provide safe, clear access to the working area on the agreed dates, and access to water and electricity where the work requires it.
- Tell us in advance about buried services, cables, pipes, septic systems, soakaways and any known contamination.
- Obtain any consent needed from a landlord, management company, neighbour or local authority, including for work on boundary trees and hedges.
- Secure pets and keep children away from the working area, tools and any treated surfaces.
- Tell us about anyone on site with a relevant allergy or respiratory condition before we apply any treatment.
- Move or protect vehicles, furniture and ornaments you value from the working area.
We are not liable for damage to unmarked underground services, or to plants and structures we were not told about, where that damage could not reasonably have been avoided.
11. Pesticides & treatments
- We follow an integrated pest management approach. Organic and cultural controls are used first; synthetic chemical treatment is proposed only where those have genuinely failed.
- No chemical treatment is applied without your prior agreement, recorded in writing.
- We use only products approved for use in Japan, applied at label rates, by trained personnel.
- Every application is logged with product, active ingredient, rate, date, target and the pre-harvest interval, and a copy is provided to you.
- You are responsible for keeping people, pets and livestock off treated areas for the re-entry period we specify, and for observing pre-harvest intervals on edible crops.
- Where products are supplied to you for self-application, you are responsible for storing them safely and securely, following the label in full, and disposing of surplus and containers through municipal chemical waste channels. The label is the law.
- Treatment reduces pest and disease pressure. It cannot guarantee eradication, and re-infestation from neighbouring land is outside our control.
12. The Plant Doctor tool
The Plant Doctor on this site is an informational aid. It narrows common problems by symptom; it does not perform a diagnosis, and it has not examined your plant.
- Information is general horticultural guidance, not a professional diagnosis or a prescription.
- Active ingredients are named for identification only. Availability and legal approval vary by country and change over time — confirm current approval for your crop before purchasing anything.
- Always read and follow the product label, which overrides anything written on this site.
- For mature trees, structural concerns, or where a whole crop is affected, obtain a professional on-site inspection.
- We accept no liability for loss arising from action taken solely on the basis of the tool's output. Where you engage us for a paid inspection, our normal professional obligations apply in full.
13. Maintenance contracts
- Contracts are monthly rolling, cancellable by either party on 30 days' written notice.
- The visit frequency, scope and any seasonal variation are set out in your contract schedule.
- Visits missed because of weather are rescheduled within the same month wherever practicable.
- Visits we cannot make because access was not available are treated as delivered.
- Work outside the agreed scope is quoted separately before it is carried out.
- We provide a photo report after every visit.
14. Workshops & community sessions
- Community sessions at the garden are free and open to all. Attendance is at your own risk.
- Gardening involves sharp tools, uneven ground, soil-borne organisms and allergens. Please dress appropriately, follow instructions given on site, and tell a session lead about any relevant medical condition.
- Under-16s must be accompanied by a responsible adult.
- We may photograph sessions for our own social media. Tell any session lead if you would rather not appear, and we will respect that.
- Paid workshops require booking. Cancel more than 7 days ahead for a full refund; within 7 days we offer a transfer to another date rather than a refund.
- Sessions may be cancelled at short notice for typhoon or severe weather warnings. Check our Instagram if conditions look serious.
15. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.
Subject to that:
- Our total liability arising out of any engagement is limited to the amount you have paid us for that engagement.
- We are not liable for indirect or consequential loss, loss of profit, loss of enjoyment, or loss of anticipated harvest.
- We are not liable for loss caused by weather, typhoon, flood, earthquake, disease outbreak, pest pressure originating off site, or other events beyond our reasonable control.
- We are not liable for the consequences of aftercare carried out by you or a third party contrary to the written schedule we supplied.
- We maintain public liability insurance. Details are available on request.
16. Intellectual property
All content on this site — text, illustrations, layout, code and the growing guidance we publish — is our property or licensed to us, and is protected by copyright.
- You may read, print and share our guidance for personal, non-commercial use with attribution.
- You may not republish it commercially, or reproduce our illustrations or code, without written permission.
- Garden plans and drawings we produce for you are licensed to you for use at the site they were drawn for, including by another contractor. We retain copyright and the right to photograph the completed work for our portfolio, unless you ask us in writing not to.
17. Complaints
If something is wrong, tell us as soon as you notice — most problems are far easier to fix in the first week than in the third month.
- Contact us by phone or email with the details and, where relevant, photographs.
- We acknowledge within 2 working days.
- We inspect where necessary and respond with a proposed remedy within 10 working days.
- Where we are at fault, we put it right at our cost.
18. Changes to these terms
We may update these terms from time to time. The version published on this page at the moment you place an order or accept a quotation is the version that governs that engagement. Material changes will be flagged on this page with a revised "last updated" date.
19. Governing law
These terms are governed by the laws of Japan. Any dispute that cannot be resolved between us will be subject to the exclusive jurisdiction of the courts of Oita Prefecture, Japan.
Nothing in these terms restricts the statutory rights of a consumer under Japanese law.
